Exclude leases from the charter's franchise definition
South Miami city · November 3, 2026
The question on your ballot
The Charter currently defines a franchise to include leases and other limited-term property interests in City-owned real property, requiring two advertised public hearings and limiting the term to fifty years. Shall the Charter be amended to define a franchise as a right to use public property, and to exclude property interests and leases, where leases would still require an ordinance adopted by four-fifths vote after advertised public hearing?
In plain language
A VoterDecoder summary of the official measure text.
The South Miami charter currently defines a franchise to include leases and other limited-term property interests. Franchises need two advertised public hearings and last no more than fifty years. This amendment would define a franchise as a right to use public property. It would exclude property interests and leases from that definition. Leases would still need an ordinance adopted by a four-fifths vote. A YES vote adopts this definition. A NO vote keeps the current definition.
